ProChase - Terms of Service

1. Who we are and what these Terms cover

1.1. The services described in these Terms are provided by Palma Studio Łukasz Kaczmarski, ul. Stanisława Moniuszki 4a, 90-111 Łódź, Poland, VAT ID PL7292507843, REGON 380333900, e-mail: info@palmastudio.pl ("we", "us").

1.2. These Terms set out the rules for using the ProChase website and the free services we provide online: sending a link to download the trial version, making the source code of libraries available, the newsletter and the activation page.

1.3. These Terms do not cover:
- use of the ProChase program, including the program's connections to our server for the trial version and activation - these are governed by the licence agreement, which you accept in the installer;
- purchase of a licence - sales are handled by the seller indicated at purchase, under its own terms, and in direct sales the terms of the order apply.

1.4. The processing of personal data is described in the Privacy Policy.

1.5. These Terms are available on the website in the legal documents section before you use the services and at any time afterwards. You can download, save and print them.


2. Definitions

Consumer - a natural person using the services for purposes not directly related to their business or professional activity.

Trader - a natural person, legal person or organisational unit using the services for purposes directly related to their business or professional activity.

Trader with consumer protection - a Trader who is a natural person and for whom the agreement is not of a professional nature, as follows in particular from the registered scope of their business (in Poland - as disclosed in the Central Register and Information on Business, CEIDG); to the extent provided by law, such a person has the rights of a Consumer.

Website - the ProChase website at prochase.palmastudio.pl, including its subpages.

Services - the services described in clause 3.


3. Services

3.1. Browsing the website - on the website we provide information about the ProChase program, including how it works, its requirements, prices and licence terms, as well as legal documents.

3.2. Trial download link - when you enter your e-mail address in the form, we send a message to it with a personal link to download the trial version installer. The link is valid for 7 days and allows a limited number of downloads.

3.3. Source code of libraries - download of the source code of the FFmpeg libraries included with the program, without providing any data.

3.4. Newsletter (mailing list) - e-mail messages about ProChase and the Palma Studio offering: new versions, fixes, new products and offers.

3.5. Activation page - activation of the program on a computer without internet access using a request file and an activation file, and viewing and releasing the workstations (seats) assigned to a licence key. On the page, a workstation can be released at most three times within 12 months; once this limit has been used up, we will release a workstation upon a justified request sent to info@palmastudio.pl, in particular if a computer has failed or been lost, provided that further use of the program remains within the licence terms.

3.6. The services described in this clause are free of charge. These Terms do not cover the licence for the program (clause 1.3). You bear the cost of your internet connection under your agreement with your provider.


4. Technical requirements

To use the services you need:
- a device with internet access and an up-to-date web browser with JavaScript enabled (browsers have it enabled by default);
- an active e-mail account - to download the trial version and for the newsletter;
- a licence key and a request file saved by the program - for activation by file and managing workstations.

Running the program requires a computer that meets the requirements stated on the website.


5. Conclusion and termination of agreements

5.1. Browsing the website - the agreement is concluded when you open the website and expires when you leave it.

5.2. Trial download link - the agreement is concluded when you submit the form and expires when the link is no longer valid or the download limit has been used up. The expiry of this agreement does not affect the use of the downloaded trial version, which is governed by the licence agreement.

5.3. Source code of libraries and activation page - the agreement is concluded when you use the given function and expires once it has been performed.

5.4. Newsletter - the agreement is concluded when you confirm your subscription using the link in the message and continues for an indefinite period. You can cancel it at any time using the link included in every message.

5.5. You can cancel any service at any time, without giving a reason and at no cost. A Consumer and a Trader with consumer protection may also withdraw from the agreement within 14 days of its conclusion, without giving a reason, by sending a statement to info@palmastudio.pl. To meet the deadline, it is sufficient to send the statement before it expires.

5.6. We may terminate the agreement with immediate effect if you use the service in breach of the law or of these Terms.

5.7. We may discontinue a given service by announcing it on the website at least 14 days in advance and, to newsletter subscribers, also by e-mail.


6. Rules of use

6.1. Providing unlawful content is prohibited.

6.2. In particular, you may not:
- provide false data or another person's e-mail address without the owner's consent;
- upload to the activation page any files other than request files saved by ProChase;
- send malicious software;
- disrupt the operation of the website and services, including by submitting requests in an automated way;
- attempt to access data or parts of the server that are not intended for you.

6.3. To protect the services against abuse, we may limit the number of requests.


7. Liability

7.1. We take care to ensure that the services work properly and without interruption. Interruptions may nevertheless occur, in particular due to maintenance, failures or actions of hosting and e-mail providers. Where possible, we announce planned interruptions on the website. An interruption in the operation of our server may also temporarily prevent the trial version from starting and the program from being activated. The full version of the program works without an internet connection once activated.

7.2. We are not liable for messages not being delivered for reasons on your side or on the side of your e-mail provider, in particular an incorrectly entered e-mail address or a message stopped by a spam filter.

7.3. To the fullest extent permitted by law, we are not liable for indirect damage, lost profits, loss of data or interruptions to work connected with the use of the services or the inability to use them.

7.4. In relation to Traders, other than Traders with consumer protection, we exclude liability for damage connected with the use of the services, unless the damage was caused intentionally or through gross negligence.

7.5. These Terms do not limit the rights of a Consumer or a Trader with consumer protection under mandatory provisions of law. We do not exclude liability for damage caused intentionally or for personal injury.


8. Complaints

8.1. Send complaints about the services to info@palmastudio.pl. In the subject line, enter the name of the program and of the service the complaint concerns, for example "ProChase - activation page". Without such a subject line, the complaint may not be handled correctly. Describe the problem in the body of the message and give the e-mail address used for the service and, where possible, the date of the event.

8.2. We will reply within 14 days of receiving the complaint, to the e-mail address from which it was sent.

8.3. Complaints about the program are handled under the licence agreement. Direct payment and refund matters to the seller of the licence.


9. Risks of using the internet

9.1. Using services over the internet involves typical risks: malicious software, messages impersonating well-known senders, spam and interception of data on unsecured networks.

9.2. To reduce them:
- download the ProChase installer only via the link in our message or from the ProChase website;
- we send messages with a download link only from addresses in the palmastudio.pl domain - check the sender;
- we never ask for passwords or payment card details by e-mail;
- we do not open attachments or links in e-mail messages that we have not requested ourselves;
- use an up-to-date operating system, browser and antivirus software.

9.3. The website stores in your browser's memory only the selected website language, so that it is displayed in the same language on your next visit. It does not use cookies.


10. Governing law and dispute resolution

10.1. A Consumer may use out-of-court methods of handling complaints and pursuing claims, in Poland in particular the assistance of a municipal or district consumer ombudsman or mediation conducted by a regional inspectorate of the Trade Inspection. Information on these options is provided by the Office of Competition and Consumer Protection (UOKiK).

10.2. These Terms are governed by Polish law. For Consumers, this does not deprive them of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.

10.3. Disputes with Traders, other than Traders with consumer protection, are resolved by the court having jurisdiction over our place of business. Jurisdiction in disputes with Consumers is determined by law.

10.4. These Terms are made in Polish and English. In case of discrepancy, the Polish version prevails.


11. Changes to these Terms

11.1. These Terms bear a version number and date. The current version and earlier versions are available on the website in the legal documents section.

11.2. We may change these Terms only for valid reasons: changes in the law, changes in the scope or manner of providing the services, or the need to ensure the security of the services. We notify newsletter subscribers of a change by e-mail at least 14 days before it takes effect; if you do not accept the change, you may cancel the agreement. A change does not apply to services already performed.

11.3. These Terms apply from 22 October 2026.
